General Terms and Conditions of Sale

1. Preamble

The site www.davidjones.paris (the “Site”) is published by CCM SAS, a société par actions simplifiée (simplified joint-stock company) with a share capital of 688 000,00 euros, whose registered office is at 182-188 avenue Paul-Vaillant Couturier, 93120 La Courneuve, France, registered with the Registre du Commerce et des Sociétés (Trade and Companies Register) of Bobigny under number 342 684 958, intra-Community VAT number FR 95342684958 (“CCM”).

CCM sells the products of the brand David Jones.

These general terms and conditions of sale (the “General Terms”) are entered into between CCM and any natural person not acting for professional purposes (the “Customer”) wishing to make a purchase on the Site. Any order constitutes unreserved acceptance of the General Terms in force on the date of the order.

CCM reserves the right to modify the General Terms at any time. The General Terms applicable to an order are those online at the time the order is placed; a subsequent modification has no effect on orders already validated.

2. Products

The products governed by these terms are those appearing on the Site and indicated as sold and dispatched by CCM (the “Products”). Offers are valid for as long as they are visible on the Site and while stocks last.

The photographs illustrating the Products are as faithful as possible but are not contractual, in particular as regards the exact rendering of colours, which depends on the screen used.

The Products do not contain spare parts essential to their use: the information obligation provided for by Article L. 111-4 of the Code de la consommation (French Consumer Code) does not apply.

3. Prices

The prices of the Products are stated in euros, all taxes included. They take account of VAT and of any reductions applicable on the day of the order.

Prices are exclusive of delivery charges. The amount of the delivery charges is indicated to the Customer before validation of the order, and appears on the order summary.

If one or more taxes or contributions, in particular environmental ones, were to be created or modified, whether upwards or downwards, this change may be passed on to the sale price of the Products. A price cannot, however, be modified once the order has been validated.

4. Order

Orders placed on the Site are reserved for end purchasers. The resale or distribution of Products bought on the Site is prohibited.

To place an order, the Customer must be of full age, have legal capacity and hold an accepted means of payment.

4.1 Identification

The Customer may order by creating an account or as a guest. Creating an account is free; it makes it possible to keep billing and delivery information and to follow the order history.

The username and password are confidential and must not be disclosed. Any order placed using these login details is deemed to have been made by the Customer holding the account. In the event of loss, theft or fraudulent use of their password, the Customer undertakes to inform CCM without delay.

4.2 Validation of the order

After validating their basket, the Customer chooses their address and delivery method, then proceeds to payment. Validation of the payment formalises the contract of sale. The Customer is invited to check the details of their order, its total price and the accuracy of the information they have entered before validating; they may correct any errors at each stage of the process.

The double click associated with the authentication procedure constitutes an electronic signature having, between the parties, the same value as a handwritten signature.

CCM sends the Customer an acknowledgement of receipt of the order by electronic mail, summarising its content.

The Customer must check the completeness and accuracy of the information they provide. CCM cannot be held liable for the Customer's data-entry errors and their consequences in terms of delay or delivery error; the resulting re-shipping charges remain payable by the Customer.

In the event of failure to pay, a manifestly incorrect address or any other problem connected with the account, CCM reserves the right to suspend the order until the problem is resolved, and informs the Customer accordingly.

4.3 Proof of the transaction

The computerised records kept by CCM under reasonable security conditions constitute proof of the communications, orders and payments made between the parties. Purchase orders and invoices are archived on a reliable and durable medium that may be produced as evidence.

The contractual information is presented in the French language and confirmed by electronic mail no later than at the time of delivery.

5. Payment

The Customer pays for their order by bank card: Carte Bleue, Visa, Mastercard or by PayPal.

The debit is made at the time of validation of the payment. Processing and dispatch of the order take place only after verification of the means of payment and receipt of the debit authorisation.

CCM reserves the right to refuse to fulfil an order from a Customer who has not paid, even partially, for a previous order, or with whom a payment dispute is ongoing.

The Customer agrees to receive their invoices in electronic form.

The Products remain the property of CCM until full payment of the sums due has been received. Risk passes to the Customer from the physical handing over of the Product to the Customer or to a third party designated by them, other than the carrier chosen by CCM.

6. Preparation and dispatch

Orders are prepared within two (2) working days maximum, subject to availability, from validation of the payment. This preparation time does not include the transit time.

Preparation times may exceptionally be extended during busy periods (sales, end-of-year holidays), in the event of a temporary stock shortage or of force majeure. CCM then informs the Customer by electronic mail or by telephone.

7. Delivery

7.1 Areas, methods and prices

Parcels are dispatched via Colissimo, with a tracking number and delivery without signature. A tracking link is sent to the Customer at the time of dispatch.

CCM delivers in France métropolitaine (mainland France) and in nine countries of the European Union: Germany, Austria, Belgium, Spain, Greece, Italy, Luxembourg, the Netherlands and Portugal. No delivery is made outside the European Union.

The free carriage allowance applies exclusively to the point relais (pickup point) method, from 49 euros of purchases. Home delivery and luggage remain chargeable whatever the amount of the order.

The shipping charges cover preparation, packaging and transit. The exact amount applicable to the order is displayed before validation of the payment.

7.2 Absence of the recipient

If the recipient is absent when the carrier calls, the parcel is made available at a pickup point near the delivery address. Parcels not collected within the allotted time are returned to CCM. CCM accepts no liability for delays resulting from the absence of the recipient or from the failure to collect the parcel within the time allowed.

7.3 Delay and force majeure

CCM cannot be held liable for delays attributable to the carrier, in particular in the event of a total or partial strike affecting the means of transport or communication.

If CCM is prevented from performing the order by an event of force majeure, the delivery time is extended accordingly. CCM informs the Customer by electronic mail of the occurrence and the end of the impediment. If it lasts more than four (4) weeks, either party may terminate the order as of right, the Customer then being refunded in full.

7.4 Claims

On receipt, the Customer is invited to check the condition of the parcel and the conformity of the Products. If the parcel is damaged, it is recommended to make precise reservations on the carrier's delivery note and to contact customer service at serviceclient@davidjones.fr.

Any delivery failure or delay of more than eight (8) working days must be reported to customer service as soon as possible. These recommendations do not prevent the exercise of the statutory guarantees referred to in Article 9, or of the right of withdrawal referred to in Article 8.

8. Right of withdrawal

In accordance with Articles L. 221-18 et seq. of the Code de la consommation (French Consumer Code), the Customer has a period of fourteen (14) calendar days from receipt of the Product — or of the last Product in the case of a multiple order — to exercise their right of withdrawal, without having to give reasons for their decision or to bear any cost other than the return postage.

8.1 How to withdraw

The Customer informs CCM of their decision by means of an unambiguous statement, for example:

         by electronic mail to serviceclient@davidjones.fr, stating their order reference;

         or by using the model withdrawal form appearing in the appendix to these terms.

In order to facilitate processing, CCM invites the Customer to announce their return before sending the parcel back and then provides them with the return instructions. This step is a practical convenience: it is not a condition of the exercise of the right of withdrawal.

8.2 Return of the Product

The Customer returns the Product no later than fourteen (14) days after communicating their decision to withdraw, to the following address:

The return postage is payable by the Customer. CCM recommends a tracked shipment: the Customer bears the risk of loss of the returned parcel.

The Customer may handle the Product as they would have done in a shop in order to check its nature and characteristics. They are liable only for any diminution in value resulting from handling going beyond what is necessary for that check. Returning the complete Product, with its labels and its original packaging, is therefore strongly recommended.

8.3 Refund

CCM refunds the Customer no later than fourteen (14) days from recovery of the Product.

The refund is made by the same means of payment as that used at the time of purchase.

8.4 Exchange

CCM does not offer exchanges or credit notes: orders can only give rise to a refund via the means of payment used at the time of purchase.

9. Statutory guarantees

Independently of the right of withdrawal, the Customer benefits from the following statutory guarantees, which apply for two years and are implemented at no cost to them.

Garantie légale de conformité (statutory guarantee of conformity) (Articles L. 217-4 to L.217. of the Code de la consommation)

The Customer has a period of two (2) years from delivery of the Product in which to act in the event of a lack of conformity. They may request that conformity be restored by repair or replacement, at their choice, subject to the cost conditions provided for by law. They are exempt from proving the existence of the defect during the twenty-four (24) months following delivery.

If restoring conformity is impossible, refused, late or a source of major inconvenience, the Customer may obtain a reduction in the price or the rescission of the contract.

Any repair under this guarantee extends it by six (6) months. Replacement of the Product starts a new two-year guarantee.

Garantie des vices cachés (guarantee against hidden defects) (Articles 1641 to 1649 of the Code civil (French Civil Code))

The Customer may also rely on the guarantee against hidden defects within a period of two (2) years from the discovery of the defect, and obtain the rescission of the sale or a reduction in the price.

Implementation

Any claim under the statutory guarantees is to be sent to serviceclient@davidjones.fr. The cost of returning a non-conforming Product is borne by CCM. Depending on the case, CCM will repair, replace or refund the Product.

These guarantees cover neither normal wear resulting from regular use, nor damage arising from use not in accordance with the purpose of the Product, from a lack of care or from a modification made by the Customer, an accident, an impact, a fall, an external cause ( liquid, bad weather, sand, fire, animal, chemical products)

Important note: these limitations do not restrict the Customer's legal rights as provided for by the Code de la Consommation and the Code Civil.

10. Personal data

The data collected on the occasion of the order is the subject of processing described in the “Politique de confidentialité” (Privacy Policy) and in the “Mentions légales” (Legal Notice).

11. Intellectual property

The constituent elements of the Site and the David Jones brand are the exclusive property of CCM. Their use is governed by the “Mentions légales” (Legal Notice) and the “Conditions d'utilisation” (Terms of Use).

12. Mediation and settlement of disputes

In the event of a complaint, the Customer contacts customer service in the first instance: serviceclient@davidjones.fr.

Failing a satisfactory solution, and in accordance with Article L. 612-1 of the Code de la consommation (French Consumer Code), the Customer may have recourse free of charge to the médiateur de la consommation (consumer ombudsman) to which CCM belongs:

Recourse to mediation is optional and does not deprive the Customer of any legal remedy.

13. Applicable law and jurisdiction

These General Terms are governed by French law.

In the event of translation, the French version prevails.

Any dispute relating to the existence, interpretation, performance or termination of the contract entered into between CCM and the Customer, even in the case of multiple defendants, shall fall within the exclusive jurisdiction of the French courts pursuant to the rules laid down by the French Code of Civil Procedure.
