1. Purpose
These terms govern access to the site www.davidjones.paris and its use. They apply to every visitor, whether or not they place an order.
The terms applicable to the purchase of products are the subject of a separate document: the “Conditions générales de vente” (General Terms and Conditions of Sale).
The site is published by CCM SAS, a société par actions simplifiée (simplified joint-stock company) with a share capital of 688 000,00 euros, whose registered office is at 182-188 avenue Paul-Vaillant Couturier, 93120 La Courneuve, registered with the RCS (Trade and Companies Register) of Bobigny under number 342 684 958 (“CCM”). By accessing the site, you accept these terms. If you do not accept them, it is for you not to use it.
2. Access to the site
The site is accessible free of charge, 24 hours a day and 7 days a week, except for interruption for maintenance or an event of force majeure.
CCM endeavours to ensure the availability and accuracy of the information published, without being able to guarantee the complete absence of error, interruption or delay. CCM reserves the right to modify, suspend or discontinue all or part of the site, at any time and without notice.
The costs of internet access and the necessary equipment remain at your expense.
3. Customer account
Creating an account is free and optional: you may also order as a guest.
You undertake to provide accurate information and to keep it up to date. Your login details are strictly personal and confidential; you are responsible for keeping them safe and for any activity carried out from your account. In the event of loss, theft or fraudulent use, inform us without delay at serviceclient@davidjones.fr.
CCM may suspend or delete an account in the event of a breach of these terms, fraudulent use or non-payment.
You may delete your account at any time by writing to us at serviceclient@davidjones.fr.
4. Permitted use
You undertake to use the site in accordance with its purpose and with the law. The following are prohibited in particular:
• the extraction or re-use, qualitatively or quantitatively substantial, of the content of the site or of its databases, including by automated means — robots, site rippers, scraping;
• any attempt at unauthorised access to systems, accounts or data;
• any action liable to disrupt the operation of the site or to impair its security;
• use of the site for the purposes of resale or distribution of the products, expressly prohibited by the General Terms and Conditions of Sale;
• the publication of unlawful, defamatory or insulting content, or content infringing the rights of third parties, in those areas that allow contributions.
5. Intellectual property
All the elements of the site — texts, photographs, illustrations, drawings, designs, logos, trade marks, structure, software — are protected by the Code de la propriété intellectuelle (French Intellectual Property Code) and remain the exclusive property of CCM or of its rightful owners.
Nothing in these terms constitutes an assignment of any right whatsoever. You have a simple private, personal and non-exclusive right to use the content of the site.
The following are prohibited in particular, without the prior written authorisation of CCM: the reproduction, representation, adaptation, translation, distribution and commercial exploitation of all or part of the site.
The brand David Jones and the domain names davidjones.paris, davidjones.fr are the exclusive property of CCM.

6. Hypertext links
The creation of a simple link to the site is free. However, the embedding of pages of the site in another site by means of framing (frame or iframe), as well as any presentation suggesting a commercial or editorial connection with CCM, are prohibited.
The site may link to third-party sites, over which CCM exercises no control and for the content of which it accepts no responsibility.
7. Personal data and cookies
The processing of your personal data and the use of cookies are described in the “Politique de confidentialité” (Privacy Policy) and in the “Mentions légales” (Legal Notice).
8. Liability
CCM implements reasonable means to ensure the accuracy of the information published and the security of the site. It cannot be held liable for any damage resulting from use of the site not in accordance with these terms, from a temporary unavailability, or from an event beyond its reasonable control.
Nothing in these terms has the effect of limiting the rights you hold under the law as a consumer, and in particular the statutory guarantees described in the “Conditions générales de vente” (General Terms and Conditions of Sale).
9. Modification of the terms
CCM may modify these terms at any time. The applicable version is the one online at the time of your visit. We invite you to consult it regularly.
10. Applicable law
These terms are governed by French law.
In the event of a dispute, you may refer the matter free of charge to the médiateur de la consommation (consumer ombudsman) whose contact details are given in our “Mentions légales” (Legal Notice), without this depriving you of any legal remedy.
The site complies with French legislation. CCM does not guarantee its compliance with the local legislation applicable to visitors accessing the site from other countries.
